The Terms & Conditions of Transacting with Fashion Furniture:

1. Information about the site and us
1.1 This website published as www.fashionfurniture.co.za (hereafter referred to as “Fashion Furniture”, “our site” or “the site”) is owned and managed by the owners of Fashion Furniture. Our address of business and showrooms are as indicated at the bottom of all pages.
1.2 Our site is operated and managed as prescribed by the Electronic Communications and Transactions Act of 2002 (ECTA)
1.3 We adhere to the Consumer Protection Act of 2008 (CPA). This is to ensure all our customers of a safe, fair transaction agreement and service.
1.4 We do request and rely on fair and responsible consumer behaviour from all our valued customers.
1.5 Our office working days are Mondays to Fridays from 9:00 am to 4:00 pm. The site though operates 24 hours and 365 days.
2. Your status
By using our site and placing an order you declare that:
2.1 You are legally accountable and capable of entering into binding contracts; and
2.2 You are at least 18 years old.
2.3 Hereafter you will be referred to as "the customer".
3. How an agreement is reached between you and Fashion Furniture
3.1 When you have selected and placed a product into the Cart and have completed the Checkout process, you have placed an official order to buy such goods or product(s) from us.
3.2 You will then receive an automated confirmation that your order has been received by us and that we will be processing it shortly.
3.3 Once your order has been processed, you automatically enter into an agreement with Fashion Furniture and the Terms & Conditions of Sale Agreement, as described herein, becomes applicable.
3.4 You cannot enter into a transaction with us without accepting our Terms & Conditions of Sale Agreement.
3.5 We reserve the right to do an identity check or conduct credit checks on all our prospective clients.
4. Suitability of Goods
4.1 We do not warrant the suitability of any goods or product(s) for any specific and/or particular use or application other than to what the manufacturer has indicated.
4.2 The Customer must ensure that any goods or product(s) you intend purchasing does indeed suit your particular specifications and/or needs for your application.
4.3 When you purchase a bed or mattress you should be sure that the applied weight will not exceed the maximum weight restriction set by the manufacturer as this may invalidate your guarantee and warranty on any such product.
5. Prices and Specifications
5.1 All prices indicated for goods or product(s) are valid at the time of your transaction. Prices are subject to change without notice and we reserve the right to change advertised, presented or quoted prices to be higher or lower than previously advertised at any time.
5.2 If your order has been processed the current price will be valid and reflected with the confirmation to you that your order has being accepted.
5.4 We are a Non VAT Vendor and can not issue a VAT Invoice.
5.5 We reserve the right to change the price or specifications of any goods or product(s) without notice and all new orders thereafter will be subject to such changes.
5.6 No prices, special offers or promotions will be extended for any reason or for any duration of time once the stock on special or promotion has been sold out or the promotional time period has lapsed.
6.1 Any quotation issued is only valid if it has been received by you as presented to you by us originally.
6.2 A quotation is only valid for the time indicated therein or while stocks last or for the period that has been indicated by any promotion time period.
6.3 When a quotation is issued and the price includes other products that are bundled together as a group, the quotation is only valid when all the items on the quotation are purchased as presented in one transaction, including any delivery and administrative charges.
6.4 The price normally indicated for any separate or additional goods or product(s) are valid when purchased on their own and a new quote will need to be issued for those items or such order.
7. Acceptance of your order
7.1 All goods or product(s) added to the shopping cart including their prices is considered to be an order to purchase any such goods or product(s).
7.2 We remain entitled to reject any order and will then give the reason/s for us doing so. No negotiation will thereafter be reconsidered as our decision will be final.
7.3 Although the site is set up to automatically confirm receipt of your order, technical or other problems may delay or prevent such confirmation.
7.4 If you have not received confirmation from us within 4 hours after presenting your order you should contact us immediately.
7.5 Do not re-submit your order as this may lead to a duplicate transaction for which you may be held liable.
7.6 When you receive an automated confirmation it merely confirms our systems reception of your order and that we will be processing it shortly.
7.7 Our processing division is operational from Monday to Friday from 9 am to 4 pm. Should you have placed your order on Friday at 4:01 pm, it may only be attended to by our staff on the next working day (excluding public holidays) thereafter.
7.9 Once we accepted and confirmed your order to purchase goods or product(s), you become our client (the customer) and enter into an agreement with Fashion Furniture. You will then be bound by the Terms and Condition of Sale Agreement as described herein.
7.10 We reserve the right to reject any order and return any payment to you and indicating our reason/s for doing so. Receipt of payment from you does not mean that we have accepted your order.
7.11 If your order has been rejected, we will return any payment with notification of your offer being rejected normally within fifteen (15) working days or twenty-one (21) days from payment having being affected.
8. Stock availability
8.1 Although we manage all stock daily, any product(s) may without notice run out of stock, become on back order or may have become discontinued.
8.2 Stock availability confirmation is only valid for three (3) business days from the time of confirmation and unless the customer has requested for us to hold such stock for a longer period, it will thereafter be continued to be sold on a first come, first serve basis.
8.3 All goods or product(s) are individually subject to a specific delivery time or lead time as indicated with such goods or product(s).
8.4 Our maximum delivery time is normally fifteen (15) working days or twenty-one (21) days from payment having being affected for any product unless otherwise indicated thereafter to allow for restocking of required goods or product(s).
8.5 Since we redistribute all goods or product(s) as we get stocked from our suppliers, participate in Dropshipping, the maximum delivery time may still vary as it is therefore completely out of our control if there are any delays in being stocked by our supplier for any particular reason.
8.6 As stock availability cannot be guaranteed and any stock can/may become unavailable for many reasons, the quotation or order will become null and void since the goods and/or product(s) may no longer be available within the maximum normally fifteen (15) working days or twenty-one (21) days from payment having being affected.
8.7 If you have paid for any goods or product(s) and its stocking is delayed or is no longer available, a full refund will be made to you within twenty-one (21) days unless you agree to wait a longer period for new stock arrival or availability.
8.8 All refunds will be made in the same form of payment as we have received the payment.
8.9 After you have been refunded and you want to purchase the product later on once it has been restocked, any price adjustment will be applicable and paid by you if such new price is higher than the previous transaction time.
9. Payment accepted
9.1 Full payment, including any applicable delivery fees, must have been affected to us and reflect in our bank account before processing of any order will commence.
9.2 We accept the following means of payment for purchases made:
9.2.1 Direct cash deposited into our bank account - Direct cash deposits can be made into our banking account by making such deposit at any of our bank's branches.
9.2.2 Electronic Funds Transferred (EFT) into our bank account - Electronic Funds Transfer can be made to our banking account by transferring money electronically from your banking institution.
9.2.3 Direct Transfer from your credit card account into our bank account - Electronic Funds Transfer can be made to our banking account by transferring money electronically from your credit card via your banking institution.
9.2.4 Credit or Debit card - Pay with your credit or debit card via the Payfast payment gateway.
Payfast utilizes Extended Validation SSL with 256-bit Encryption, which is the highest available card security currently available.

9.3 We do not accept payment by Cheque.
9.4 We only accept payment is South African Rand (ZAR)
No deliveries or collections may occur on weekends and/or holidays unless arranged.
